1. HIPAA Notice of Privacy Practices

This Notice describes how medical information about you may be used and disclosed and how you can get access to this information. Please review it carefully.

Who We Are

Kids2Dentist is a covered entity under the Health Insurance Portability and Accountability Act (HIPAA). We operate pediatric dental clinics in Fresno, Visalia, Delano, Porterville, and Clovis, California. We are required by law to maintain the privacy of your Protected Health Information (PHI) and to provide you with this Notice.

How We Use & Disclose Your PHI

We use and share your health information for the following primary purposes without requiring your authorization:

  • Treatment: To provide, coordinate, and manage dental care. For example, we may share records with a specialist or oral surgeon to whom we refer your child.
  • Payment: To bill and collect payment from you, your insurer, or Medi-Cal/CHIP for services provided.
  • Health Care Operations: For quality assurance, staff training, audits, and general administrative activities necessary to run our practice.
  • Required by Law: When required by federal, state, or local law (e.g., reporting child abuse or neglect to authorities).
  • Public Health Activities: To report disease outbreaks to public health authorities, or as required by law to prevent serious harm.

Other uses and disclosures — such as for marketing, research, or fundraising — require your written authorization. You may revoke that authorization at any time in writing.

Your Rights Regarding Your Health Information

  • Right to Access: You may request a copy of your (or your child's) dental records. We may charge a reasonable fee for copies.
  • Right to Amend: You may ask us to correct information you believe is incomplete or inaccurate. We may deny the request in certain circumstances.
  • Right to an Accounting: You may request a list of certain disclosures we have made of your PHI, excluding treatment, payment, and operations.
  • Right to Restrict: You may ask us to restrict how we use or share your PHI. We are not required to agree, except in limited circumstances (e.g., if you pay out of pocket in full).
  • Right to Confidential Communications: You may request that we contact you in a specific way (e.g., only by cell phone or at a specific address).
  • Right to a Paper Copy: You may request a paper copy of this Notice at any time, even if you have agreed to receive it electronically.

Our Duties

We are required by law to maintain the privacy of your PHI, provide this Notice, abide by the terms of the Notice currently in effect, and notify you following a breach of unsecured PHI. We reserve the right to change our privacy practices and apply those changes to all PHI we maintain. If we make material changes, we will post the revised Notice at our clinics and on this website.

Complaints

If you believe your privacy rights have been violated, you may file a complaint with Kids2Dentist or with the U.S. Department of Health and Human Services Office for Civil Rights at hhs.gov/ocr. We will not retaliate against you for filing a complaint.

2. Children's Privacy (COPPA)

Because our patients are children, we take special precautions under the Children's Online Privacy Protection Act (COPPA), which applies to the online collection of personal information from children under 13.

  • Our website is not directed at children. We do not knowingly collect personal information directly from children under 13 through this website.
  • All online appointment requests and contact forms must be completed by a parent or legal guardian.
  • Clinical records of minor patients (dental charts, X-rays, treatment notes) are governed by HIPAA and applicable California state law. Parents and legal guardians generally have the right to access their minor child's records, subject to limited exceptions under California Health and Safety Code.
  • If you believe we have inadvertently collected information from a child under 13, please contact us immediately and we will delete it promptly.

3. California Privacy Rights (CCPA/CPRA)

California residents have additional rights under the California Consumer Privacy Act (CCPA) and the California Privacy Rights Act (CPRA). This section applies to personal information collected through our website and non-clinical communications.

Note: Personal health information covered by HIPAA is exempt from the CCPA/CPRA. The rights below apply to non-clinical personal information (e.g., website usage data, marketing preferences).

Information We Collect

In the past 12 months, we have collected:

  • Identifiers (name, email address, phone number) from contact and booking forms
  • Internet activity data (pages visited, browser type, IP address) via Google Analytics
  • Geolocation data at the city/region level from analytics tools

We do not sell your personal information. We do not share it with third parties for cross-context behavioral advertising.

Your California Rights

  • Right to Know: You may request details about the categories and specific pieces of personal information we have collected about you, where it came from, and how it has been used or shared.
  • Right to Delete: You may request that we delete personal information we collected from you, subject to certain exceptions (e.g., information needed to complete a transaction or comply with a legal obligation).
  • Right to Correct: You may request that we correct inaccurate personal information we maintain about you.
  • Right to Opt-Out of Sale/Sharing: You have the right to direct us not to sell or share your personal information. We do not currently sell or share personal information for cross-context behavioral advertising.
  • Right to Non-Discrimination: We will not discriminate against you for exercising any of your CCPA/CPRA rights.

4. Website Data & Cookies

Analytics

We use Google Analytics to understand how visitors use our website. Google Analytics collects information such as pages visited, time on site, browser type, device type, and approximate geographic location (city/region level). This data is aggregated and does not identify you personally. Google's data practices are governed by the Google Privacy Policy.

You can disable cookies in your browser settings at any time. Disabling the NEXT_LOCALE cookie will reset your language to the default. Disabling Google Analytics cookies will not affect site functionality. You can also opt out of Google Analytics tracking at tools.google.com/dlpage/gaoptout.

Contact Forms & Appointment Requests

When you submit a contact form or appointment request, we collect the information you provide (name, phone number, email, preferred location, and message). We use this information solely to respond to your inquiry or schedule your appointment. This information may become part of your patient record if you become a patient, at which point it is protected by HIPAA.

Third-Party Links

Our website may contain links to third-party websites (e.g., insurance portals, Google Maps). We are not responsible for the privacy practices of those sites and encourage you to review their privacy policies.
